Terms of Service

Build responsibly.

These Terms govern your use of Fractal Society, Fractal CLI, Fractal Voice, and related services provided by ACFI LLC.

You remain in control.

Fractal coordinates software agents and tools, but you are responsible for reviewing instructions, generated code, graph changes, external actions, and deployment results before relying on or distributing them.

Acceptance and eligibility

By creating an account, downloading or using the software, publishing an execution graph, or otherwise using the services, you agree to these Terms and our Privacy Policy. If you use Fractal for an organization, you represent that you have authority to bind that organization. You must be at least 13 years old and legally able to enter into these Terms. Do not use the services if applicable law prohibits you from doing so.

The services

Fractal provides local and hosted tools for turning project requests into product requirements, execution graphs, agent tasks, collaboration workflows, and project updates. Features may be experimental, may depend on local software or third-party services, and may change, pause, or be discontinued. We do not guarantee that any build, agent, model, integration, or generated result will be uninterrupted, accurate, secure, complete, or suitable for a particular purpose.

Accounts and security

You must provide accurate account information and protect your email account, authentication sessions, devices, repositories, API credentials, signing keys, and connected services. You are responsible for activity performed through your account unless you promptly report unauthorized access. Do not share magic links, device codes, access tokens, private keys, or other secrets. Contact us immediately if you believe your account or a project has been compromised.

Your projects and content

You retain ownership of project prompts, source code, execution graphs, files, and other content you submit or create. You grant ACFI LLC a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display that content only as reasonably necessary to operate, secure, and improve the services and to follow your sharing and integration choices.

You represent that you have the rights and permissions needed to use and share your content. Public projects and public repositories may be viewed, copied, indexed, or acted on by others. Private project access depends on the members and integrations you authorize. Remove credentials and confidential information before publishing.

Agent-generated work and external actions

Coding agents and AI models can misunderstand instructions, produce insecure or incorrect output, expose information supplied to them, or take unintended actions. Review material changes and use appropriate testing, version control, backups, permissions, and human approval. You are responsible for actions initiated from your account, including repository changes, deployments, messages, invitations, social posts, purchases, and use of computing resources.

Fractal is not a substitute for professional legal, financial, medical, security, or safety advice. Do not rely on generated output for high-risk decisions without qualified review.

Third-party services

Fractal may connect to services such as GitHub, X, email providers, model hosts, and coding-agent tools. Those services are operated by others and are governed by their own terms, privacy policies, availability, permissions, and fees. You authorize Fractal to exchange the information necessary to perform actions you request through an enabled integration. We are not responsible for third-party services or content.

Acceptable use

You may not use the services to:

  • Break the law, violate another person's rights, or evade legal restrictions.
  • Access accounts, systems, data, or computing resources without authorization.
  • Distribute malware, destructive code, credential theft, spam, fraud, or deceptive content.
  • Harass, threaten, exploit, or impersonate others, or facilitate unlawful surveillance.
  • Interfere with service operation, bypass safeguards or rate limits, or probe the service without permission.
  • Upload content you do not have the right to use or expose another person's confidential information.
  • Use automated accounts or agents in a way that conceals responsibility or creates abusive load.

We may investigate suspected abuse and remove content, restrict integrations, suspend projects, or terminate accounts when reasonably necessary to protect users, third parties, or the services.

Intellectual property and feedback

Except for your content and third-party materials, ACFI LLC and its licensors retain rights in the hosted service, branding, interfaces, documentation, and software. Open-source components remain governed by their applicable licenses. If you provide feedback, you permit us to use it without restriction or compensation.

To report content that you believe infringes your copyright, email auth@fractalsociety.com with identification of the protected work, the allegedly infringing material and its location, your contact information, and a good-faith explanation of your claim.

Availability, changes, and termination

You may stop using the services at any time. We may limit, suspend, or terminate access for violations of these Terms, security threats, legal requirements, prolonged inactivity, or discontinuation of a service. Where practical, we will provide notice. You are responsible for maintaining copies of local files, repositories, graphs, and other project data you need.

Disclaimers

To the fullest extent permitted by law, the services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or security. We do not warrant agent output, third-party services, or that errors or harmful components will always be detected. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, ACFI LLC and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, or computing resources arising from the services. Our total liability for claims relating to the services will not exceed the greater of the amount you paid us for the services during the twelve months before the event giving rise to the claim or US $100. These limits do not apply where liability cannot legally be limited.

Indemnity

To the extent permitted by law, you will defend and indemnify ACFI LLC against third-party claims and reasonable costs arising from your content, your misuse of the services, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim was caused by ACFI LLC.

General terms

These Terms and the Privacy Policy are the agreement between you and ACFI LLC concerning the services. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets. Applicable law governs these Terms, without regard to conflict-of-law principles, and disputes must be brought in a court with lawful jurisdiction unless applicable law requires otherwise.

Changes and contact

We may update these Terms as the services change. We will update the effective date and provide additional notice when required by law. Continued use after updated Terms take effect means you accept them. Questions may be sent to auth@fractalsociety.com. Do not include passwords, API keys, private signing keys, or confidential source code.
